Miley Cyrus Sued for Alleged Copyright Infringement Over “Flowers,” Accused of Copying Bruno Mars
Miley Cyrus is facing a lawsuit over her 2023 hit single "Flowers," with allegations of copyright infringement. Tempo Music Investments has filed the suit, claiming that Cyrus' chart-topping self-love anthem bears "striking similarities" to Bruno Mars' 2013 hit "When I Was Your Man." Interestingly, while Mars’ song is at the center of the lawsuit, he himself is not named as a plaintiff.
According to Vulture, the lawsuit alleges that "Flowers" and "When I Was Your Man" share both lyrical and musical similarities. In Mars' song, he sings, “I shoulda bought you flowers, and held your hand” and “Take you to every party, cause all you wanted to do was dance.” In a seemingly reflective twist, Cyrus sings, “I can buy myself flowers,” and “I can take myself dancing, and I can hold my own hand.” These connections, along with claims that both songs share the same melody, harmony, and chorus structure, form the basis of the suit.
The lawsuit, as obtained by People, argues that Cyrus' "Flowers" wouldn't exist without Mars' "When I Was Your Man." The complaint claims that the similarities between the two tracks are too numerous to be coincidental, stating, “It is undeniable based on the combination and number of similarities between the two recordings that ‘Flowers’ would not exist without ‘When I Was Your Man.’” The suit also makes specific claims about the opening vocal line of Cyrus' chorus, saying it begins and ends in the same chords as Mars' song.
Tempo Music Investments, which holds a share of the copyright to "When I Was Your Man" after acquiring songwriter Philip Lawrence’s music catalog, is seeking damages from Cyrus and her co-writers, Gregory Hein and Michael Pollack. Additionally, the lawsuit names Sony Music Publishing and Apple as defendants. The plaintiffs are demanding that Cyrus cease reproduction, distribution, and public performances of "Flowers."
"Flowers," which has been celebrated as a self-empowerment anthem, won Record of the Year at the 2024 Grammy Awards. Now, Cyrus will have to wait to see how this legal battle unfolds.
